These Purchase Conditions regulate the purchase of the products offered on the website www.wisdomofqara.com and its subdomains (the "Website") by the users of the Website, who declare their knowledge and acceptance by checking the box provided for this purpose. These Purchase Conditions have the same validity and effectiveness as any contract concluded in writing and signed.

Compliance with these Purchase Conditions will be enforceable against anyone who purchases any product from the Website, so if you do not agree with the terms set out, do not contract with us.

  1. PRECONTRACTUAL INFORMATION

QARA informs you that the purchase process for the products offered on the Website is detailed on the Website itself. However, you may always contact us through the channels indicated above for any information on this matter.

  1. FORMALISATION OF THE SALE AND PURCHASE

3.1. Information on the products offered

You acknowledge that the Website has shown you sufficient information on the nature and quantity of the products you wish to purchase, as well as their price and the associated VAT.

3.2. Availability

All product orders are subject to availability. If the products ordered are not available, we will inform you before processing your purchase.

3.3. Preparation and shipment costs

The price includes, in any case, the costs of packaging and labelling. However, the costs associated with the transport and delivery of the order depends on the conditions published on the website

3.5. Formalisation of the purchase

Once the purchase has been made, the user will see the information of his order on the screen and will receive an e-mail confirmation.

The order confirmation and the proof of purchase (which can be printed by the user) will not be valid as an invoice, although you can request an invoice for any order at any time and free of charge, both in electronic and paper format, through the communication channels indicated above.

3.6. Delivery of the order

The transport company contracted by QARA will be responsible for informing you of the progress of your order. In the event that the client is unable to be present at the time of delivery, the order will be delivered to any other person at the indicated address who is over 18 (eighteen) years of age. The delivery of the purchase will be made to the address indicated by the client, and the recipient must sign the corresponding delivery note. If any incident is detected at the time of delivery, including breakage, impact or deformation of the packaging, the customer or recipient must make this known in writing on the delivery note of the carrier. The carrier will contact the customer in order to establish the form and time of delivery of the goods.

  1. PAYMENT OF THE SALE

The payment of the purchase can be made:

  1. By credit or debit card: the user authentication and payment validation is carried out during the payment process by our payment services providers, so QARA will not access to your payment data. No payment can be made by false or fraudulent card. If there are reasonable grounds to believe that such an order has been placed, QARA is authorised to cancel the order and inform the competent authorities.
  1. SAFETY AND COMMERCIAL GUARANTEE

QARA will be responsible for any defective product, wrong delivery or, in general, any lack of conformity in the order that is manifested within three years from the delivery of the product.

Notwithstanding the above, please note that the products marketed by QARA may deteriorate over time, especially if the storage recommendations on the label or package are not followed and, in any case, when the recommended consumption periods (also informed on the product's label or package) have elapsed.

The deterioration of the product is part of the conditions agreed by QARA and the client at the time of purchase. Therefore, this circumstance, or any damage or harm suffered by the client or third parties as a result thereof, may not be invoked as a reason for exercising the right to the commercial guarantee.

In order to prove a lack of conformity in the product manifested at the moment of its reception, the customer may write down any incident detected at the moment of delivery in the delivery note of the carrier.

In order to communicate to QARA the client's desire to execute its commercial guarantee, the client must send an e-mail to the address above communicating the nature of the non-conformity and wait for QARA to indicate whether or not the incident is a non-conformity with what was agreed upon by the parties.

The client must then return the purchased item to QARA, and if the item is returned by courier, send a receipt to QARA to inform it of the shipping costs incurred.

Once the merchandise has been received, and after verifying that the reported discrepancies are real, QARA will proceed to pay the corresponding amount by the same means of payment used in the order, including, if applicable, the shipping costs borne by the client.

In the event that the customer's right to a commercial guarantee is denied, QARA will inform the customer that complaint forms are available.

  1. RIGHT TO WITHDRAWAL

The right to withdrawal is the right of the consumer to return a purchase made by remote means within a period of 14 days from receipt.


However, please note that the right to withdrawal does not apply to the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.


Consequently, you may exercise your right of withdrawal provided that you request it to QARA within the period indicated and that the product has not been unsealed, by contacting QARA through the channels indicated above. The return of the product and subsequent reimbursement of the price and shipping costs will be made in accordance with the procedure described in the preceding clause.

  1. PROTECTION OF PERSONAL DATA. PRIVACY POLICY

QARA is committed to respecting the confidentiality of your personal information and to guaranteeing the exercise of your rights over our personal data. For more information about the processing of your data and how to exercise your rights, please access our Privacy Policy.

  1. NULLITY AND INEFFECTIVENESS OF CLAUSES

If any clause of these Purchase Conditions were declared totally or partially null or ineffective, it would only affect that provision or part of it that is null or ineffective, with the rest of the general conditions subsisting, where reasonable.

  1. APPLICABLE LAW AND JURISDICTION

These Purchase Conditions, as well as any relationship between the user and/or client and QARA, shall be governed by Spanish law, and any dispute arising from them shall be submitted to the courts of Barcelona city (Spain).
